II. APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE

These terms and conditions apply to the sale of products by Château Marquis de Terme on its online store and by phone. They are automatically made available to the buyer on the homepage of the Château Marquis de Terme website. All the buyer needs to do is click on “General Terms and Conditions of Sale” (hereafter referred to as GTCS) to learn about the conditions of their order before even starting the ordering process. Therefore, placing an order implies the full and unconditional acceptance of these GTCS by the buyer, to the exclusion of all other documents such as prospectuses, catalogs issued by the seller, which only have indicative value. The fact that the seller does not invoke any of the provisions of these GTCS at a given time cannot be interpreted as a waiver of the right to invoke any of them at a later time. Our offers are exclusively reserved for private customers. Orders are confirmed by sending a confirmation email, but they are only final upon receipt of full payment.

III. ORDERING PROCESS

Access to the website:
Once the customer has accessed the website, they can select the product(s) they wish to order and add them to their cart, which can be found on the right-hand side of their screen. They can delete products from their cart or change the quantities by clicking on the buttons provided. Once the product(s) have been selected, the customer can confirm their order by clicking on the “PLACE ORDER” button. By clicking on this button, the customer acknowledges and agrees to waive their right to benefit from Article 1587 of the Civil Code.

Finalizing the order:
A summary of the order will be displayed on the screen. At this stage, the customer can still delete products from their cart or change the quantities by clicking on the buttons provided. To confirm the order, the customer must click on the “BUY” button. By clicking on this button, the customer expressly agrees to pay the amount of their order in order to receive the products. The customer will then be asked to accept these general terms and conditions of sale by checking the box at the bottom of the screen and clicking on the “VALIDATE PAYMENT” button. By clicking on this button, the customer commits to paying for their order.

Order confirmation:
Once the order has been finalized, the customer will receive an email confirmation of their order at the address provided when they created their account. This email will confirm the essential elements of the order, including the product(s), the price(s) of the product(s), and the delivery times and methods. This email will also remind the customer of the terms and conditions under which they can exercise their right of withdrawal.

IV. PRICES

Indication:
Prices are displayed in Euros (€). They include VAT, but exclude shipping costs. Typographical errors and manifest price errors are excepted.

Invoicing:
A detailed invoice is available upon request. Invoices are issued in Euros (€). All bank payments are made in Euros (€) or in local currency, at the customer’s choice.

Delivery time: The order preparation and shipment of packages are made within 24/48 hours following the registration of the payment of your order.

Collection from the property: Delivery is free for any order collected from the property located in Margaux (3 Route de Rauzan, 33460 Margaux).

VII. MODE AND DELIVERY TIME

Delivery is made by the carrier to the address indicated by the customer at the time of their order (or by notice of availability in the absence of the customer). Deliveries to homes are made at the bottom of the building or at the main entrance of the building. The delivery person cannot assist you in handling the packages.

Delivery times:
Delivery times vary depending on the type of delivery and the place of delivery.

In any event, delivery must take place within a maximum period of thirty (30) days from the transmission of the order. If delivery could not be ensured within this period, the consumer would be informed as soon as possible and could cancel their order. They could then request the exchange of the product or its refund.

VIII. PAYMENT

Payment conditions:
The price of the ordered items is payable in full to SARL Marquis de Terme, upon the issuance of your order form on the website, according to one of the following payment methods:

IX. TRANSPORT AND LIABILITY

The goods travel at your expense, risk, and peril. When a delivery is accepted by the customer, they can no longer report any breakage or other problem. Therefore, it is your responsibility to check the contents of the package at the time of delivery and to make reservations if necessary, in the following manner:
On the delivery slip provided by the carrier.
And, in any case, by notifying Château Marquis de Terme by registered letter with acknowledgment of receipt addressed to its registered office (3 Route de Rauzan, 33460 Margaux) within three (3) days of receiving the package.
In the event of breakage or damage during the preparation of the order or delivery, Château Marquis de Terme would do its best to deliver to you again, or otherwise reimburse you the amount paid for the order.

X. PRODUCT RETURN

In accordance with Article L. 121-16 of the Consumer Code, you have the option of using your right of withdrawal and returning, at your expense, to the address of our headquarters indicated in Article 1, the product within fourteen (14) days from delivery, in good condition and in its original packaging with the original invoice, for exchange or refund of an amount corresponding to the value of the product returned as well as initial shipping costs.

Return shipping fees:
Château Marquis de Terme will only cover the return shipping fees (at the current standard rate) if one of the following two conditions is met: the delivery is not compliant with the order or if you have made reservations with the carrier (see article 9: shipping and liability). In this case, please contact our customer service, whose contact details are provided in article 14, to choose the carrier.

XI. PROPERTY RESERVATION

Until full and effective payment of the price, Château Marquis de Terme remains the owner of the goods sold. The full payment will constitute a transfer of ownership, however, the buyer becomes responsible for the items upon delivery, the transfer of possession being a transfer of risks.

XII. CONTRACT RESOLUTION

In the event of non-payment by the customer on the agreed due date and one month after an unsuccessful formal notice, the sale will be automatically terminated if deemed appropriate by the seller, with restitution of the down payments paid by the purchaser, and the possibility for the seller to request in summary proceedings, the restitution of the already delivered products, if any, without prejudice to any other damages and interests. In the event of collection by legal means, it will result in a lump sum compensation amounting to 15% of the order amount.

XIII. CONFIDENTIALITY OF DATA

Right of access and rectification:
In order to meet your needs and provide optimal remote service, we are required to record certain information about you (name, first name, address, date of birth). You may receive offers from Château Marquis de Terme by telephone, postal or electronic mail. If you do not wish to receive them, simply write to our customer service indicating your names, first names and address or modify your information in the “Your Cart” page. In accordance with the Data Protection Act of January 6, 1978, you have the right to access and rectify the recorded data. You may also have them rectified by contacting our customer service.

Banking information:

This contract is subject to French law. Any dispute arising in the course of the execution or interpretation of this contract will be brought before the court having jurisdiction over the defendant’s domicile or the place of delivery.

XV. PROTECTION OF MINORS

In accordance with article L. 3342-1 of the Public Health Code which states that the sale of alcohol to minors under the age of eighteen (18) is prohibited, by filling out the order form, you agree to be eighteen (18) years old or older at the date of the order by checking the appropriate box.
